Court Tells Teacher: You Can Leave Your MAGA Hat On

  • The Ninth U.S. Circuit Court of Appeals ruled Thursday that a teacher from the Portland, Ore., suburbs can sue his former principal for First Amendment retaliation.
  • Eric Dodge was threatened with retaliation by Wy’east Middle School principal Caroline Garrett if he kept bringing a “Make America Great Again” hat to teacher-training sessions.
  • The unanimous three-judge panel cited “clearly established … long-standing precedent” that concerns about “the reaction to controversial or disfavored speech itself does not justify restricting such speech.”
