Roberts’ brief order follows 19 Republican-led states asking the Supreme Court to keep the policy in place, amid record migration numbers at the southern U.S. boarder.
The conservative-leaning justice ordered that a federal district court ruling that would end the enforcement of Title 42 on Wednesday be put on hold until the high court acts.
Roberts also the Biden administration and groups challenging the policy to file a response by Tuesday afternoon to the state’s request.
“Getting rid of Title 42 will recklessly and needlessly endanger more Americans and migrants by exacerbating the catastrophe that is occurring at our southern border,” said Arizona GOP Attorney General Mark Brnovich.
