Wisconsin Attorney General Sues Over Abortion Ban; Could Go To Supreme Court

Today, a Wisconsin judge will listen to arguments in a lawsuit challenging the state’s 174-year-old abortion ban, which could lead to a high-stakes courtroom battle that might reach the newly reorganized state Supreme Court.

Democrat Wisconsin Attorney General Josh Kaul filed a lawsuit in June asking to repeal the 1849 ban, stating that it is outdated and was implemented without public input.

He also claimed that a newer state law established in 1985, which permits a woman to terminate her pregnancy until a fetus can survive outside the womb, should override the older law.
