Judge Turns Down Major Gun Ban

  • In a case reminiscent of Range v. Garland, where the Third Circuit Court of Appeals ruled that Bryan Range’s conviction for falsely reporting income on a food stamp application decades ago shouldn’t lead to a lifetime gun ban, a federal judge in Pennsylvania has similarly ruled that a man’s 2005 DUI arrest and misdemeanor conviction should not disqualify him from exercising his Second Amendment rights.
  • Edward Williams, despite being convicted of a misdemeanor, faced a potential sentence of up to five years in prison. Despite not serving any jail time, he was sentenced to 90 days of house arrest and mandated to undergo treatment for drug and alcohol abuse.
  • Since the possible sentence exceeded one year, the misdemeanor conviction rendered Williams a prohibited person, restricting his ability to possess or purchase firearms.
