Men Arrested In Slaying Of NYPD Cop Diller Charged With Murder, Criminal Gun Possession

NEW YORK, NEW YORK - APRIL 13: NYPD officers patrol the subway platform at the Atlantic Avenue subway station on April 13, 2022 in the Sunset Park neighborhood of Brooklyn in New York City. A manhunt is underway for a gunman who shot 10 people, critically injuring five on the N train during Tuesday's morning rush hour. The suspect, wearing a gas mask, tossed smoke grenades on the floor and fired 33 shots before leaving the scene. At least 13 other commuters suffered injuries due to smoke inhalation, falls, and panic attacks. The police on Tuesday evening named a "person of interest" in the mass shooting and believe that they have found his personal belongings left on the train that includes a Glock 9-millimeter handgun and a key to a U-Haul van. Mayor Eric Adams this morning announced that Frank James, the "person of interest" is now considered a suspect. (Photo by Michael M. Santiago/Getty Images)

The men arrested in connection with the death last week of a New York City Police Department Officer Jonathan Diller were indicted Monday on several charges including murder.

Guy Rivera, 34, was indicted for the first-degree murder of Diller and for first-degree attempted murder for allegedly trying to fire his weapon at an NYPD sergeant at the incident in Far Rockaway.

Lindy Jones, 41, was behind the wheel of the 2016 Kia Soul when Diller and Sgt. Sasha Rosen attempted to pull him over on March 25.

Diller and Rosen repeatedly asked Rivera to roll down the window before they were able to open the car door, prosecutors said.

Once they opened the door, Rivera allegedly pulled out a gun and shot Diller in the stomach. The man then pointed his gun at Rosen and tried to pull the trigger, but the loaded gun was jammed, prosecutors also said.

Diller later died at Jamaica Hospital and was laid to rest on Saturday.

Jones was also indicted Monday on a criminal possession of a weapon charge for a second gun that was found in the car.
