Wisconsin Judge Overrules Regulators, Bars Ballot Do-Overs

  • A Wisconsin judge overruled the Wisconsin Elections Commission, ruling that state residents cannot submit a second ballot if they change their minds.
  • Judge Brad Schimel ruled that once a ballot is submitted, those votes are final.
  • The issue arose during the August primary when some candidates dropped out of races, but still appeared on the ballot. The WEC said that if voters cast ballots for one of those candidates, they could get a new ballot and vote again.
  • The is the latest court defeat for the Wisconsin Elections Commission, which also has been overruled on absentee drop boxes, the curing of ballots and the ability of WEC staff to issue election guidance.
